Two federal laws guarantee that most insured Americans can access addiction treatment coverage. Understanding these helps you advocate for the care you need.
Mental Health Parity and Addiction Equity Act (MHPAEA)
Requires most commercial insurance plans to cover mental health and substance use disorder treatment at the same level as physical health conditions. Your plan cannot impose more restrictive limits on rehab than on comparable medical care.
Affordable Care Act (ACA)
Plans sold on Health Insurance Exchanges must include mental health and substance use disorder services as essential health benefits. This has significantly expanded addiction treatment coverage across Florida since 2014.
42 CFR Part 2: Your Privacy Rights
Provides extra privacy protections for addiction treatment records beyond HIPAA. Your benefits verification and treatment information cannot be shared without your written consent, including employers, family members, or any third party.
Key Insurance Terms Explained
Deductible
Amount you pay before insurance covers costs. Separate in-network and out-of-network deductibles may apply.
Co-pay / Coinsurance
Your share per service after the deductible, either a flat fee (co-pay) or percentage (coinsurance).
Out-of-Pocket Maximum
